Terms of Use

These Terms of Use (“Terms”) govern your use of the Pulse iOS and watchOS app (“Pulse”, “the app”), developed by Oleg Klimakov (“we”, “us”). By downloading or using Pulse you agree to these Terms. If you do not agree, do not use the app.
License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Pulse on Apple devices that you own or control, as permitted by the Apple Media Services Terms and Conditions. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the app except where such restriction is prohibited by law.
Not a medical device
Pulse displays heart-rate readings from your Apple Watch or a Bluetooth sensor for fitness and informational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Readings depend on your hardware and may be inaccurate or delayed. Do not rely on Pulse to detect or manage any medical condition. Always consult a physician before starting an exercise program, and stop exercising immediately if you feel unwell. In an emergency, contact emergency services — do not rely on the app.
Your responsibility
You use Pulse during physical exercise at your own risk. You are responsible for training within your own limits and for the safe use of your device and sensors while exercising.
Subscriptions and purchases
Some features require a paid upgrade (“Pulse Pro”), offered as an auto-renewing subscription or a one-time lifetime purchase:
- Payment is charged to your Apple Account at confirmation of purchase.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; the renewal is charged within 24 hours before the period ends.
- You can manage or cancel subscriptions in your Apple Account settings at any time. Cancellation takes effect at the end of the current billing period.
- If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
- Refunds are handled by Apple under App Store policies; we cannot issue refunds directly.
Prices and the feature split between the free tier and Pulse Pro may change; changes to auto-renewing subscription pricing follow Apple’s notice and consent rules.
Health data
Pulse reads and writes workout data through Apple Health with your permission. How your data is handled is described in the Privacy Policy, which is part of these Terms.
Availability and changes
We may update, change, or discontinue the app or any feature at any time. We do our best to keep Pulse working reliably, but the app is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of readings.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of (or inability to use) Pulse, including personal injury during exercise, inaccurate heart-rate readings, or loss of data. Our total liability for any claim relating to the app is limited to the amount you paid for it in the 12 months before the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including your statutory rights as a consumer.
Termination
These Terms apply for as long as you use the app. We may terminate the license if you breach these Terms. You can stop using Pulse at any time by deleting the app; active subscriptions must be cancelled separately in your Apple Account settings.
Changes to these Terms
If we make material changes, the updated Terms will be posted on this page with a new “Last updated” date. Continued use of the app after changes take effect constitutes acceptance.
